Welcome to The Mock Exam. These Terms and Conditions ("Terms") govern your access to and use of our website, services, and practice exams at themockexam.com. Please read these Terms carefully before using our platform.

By creating an account or using The Mock Exam, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Definitions

  • "Platform" refers to The Mock Exam website, applications, and all related services
  • "User," "you," or "your" refers to any individual who accesses or uses our Platform
  • "We," "us," or "our" refers to The Mock Exam
  • "Services" refers to practice exams, study materials, performance analytics, and all features provided through our Platform
  • "Pass" refers to a one-time payment that grants access to premium features and exam content for one certification for 30 or 90 days
  • "Subscription" refers to a recurring paid plan that grants access to premium features and exam content
  • "Content" refers to all questions, answers, explanations, and educational materials on our Platform

2. Account Registration

2.1 Eligibility

You must be at least 16 years old to create an account and use our Services. By registering, you represent that you meet this age requirement.

2.2 Account Information

When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Not share your account credentials with others
  • Notify us immediately of any unauthorized access to your account

2.3 Account Responsibility

You are solely responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

3. Passes, Subscriptions and Payments

3.1 Free and Paid Exams

You can try a free 10-question preview of our practice exams and read our study guides without a subscription. Full practice exams are paid and require an active pass or subscription. Pricing and plan details are shown on our pricing page and during checkout.

Each pass or subscription gives access to the practice exams for one certification. The certification and plan you bought are shown at checkout and on your dashboard.

3.2 Payment Processing

Payments are processed securely through Stripe and PayPal. Payment details are entered on pages hosted by the provider, not by us, and we do not store your complete payment card information on our servers. By paying, you also agree to the terms of the payment provider you choose.

3.3 Passes and Billing Terms

  • 30-day and 90-day passes: A single payment for 30 or 90 days of access to one certification. Your access runs until 23:59 UTC on the last day. A pass never renews and you will not be charged again
  • Extending your access: If you buy a pass while you already have access to that certification, its days start when your current access ends, so no days are lost
  • Monthly and 3-Month Subscriptions: Billed once a month, or once every three months, from the date of purchase

3.4 Automatic Renewal

Passes never renew. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged the current subscription rate at the time of renewal.

3.5 Price Changes

We reserve the right to modify subscription prices. Any price changes will be communicated to you in advance and will take effect at your next billing cycle. A price change never affects a pass you have already bought.

4. Cancellation and Refunds

4.1 Cancellation

A pass does not renew, so there is nothing to cancel: your access simply ends on its last day.

You may cancel a recurring subscription at any time from the Subscriptions section of your account dashboard. If you have any difficulty cancelling, contact our support team and we will process the cancellation for you. Upon cancellation:

  • You will retain access to the Services until the end of your current billing period
  • Your subscription will not renew, and you will not be charged again
  • No partial refunds are provided for unused time within the billing period

4.2 Refund Policy

Payments are non-refundable once your access has started. This applies to passes, new subscriptions and renewals. The only exceptions are:

  • Billing errors: duplicate charges, or charges taken in error, are always refunded
  • A pass that has not started yet: if you bought a pass to extend access you already had, you can ask for a full refund of it at any time before its days begin
  • Faults on our side: if a problem with our Services stopped you from using them, contact us and we will fix it or extend your access. If we cannot put it right, we will give you a full or partial refund

To request a refund for one of these reasons, create a support ticket from your dashboard or email support@themockexam.com with your order details. Refunds are paid back to the original payment method.

4.3 Your Statutory Rights

If you live in the United Kingdom, the European Union, Norway, Iceland or Liechtenstein, consumer law normally gives you 14 days to cancel a purchase of digital content. At checkout, we ask you to confirm that you want your access to start immediately and that you understand you lose this right once it starts. Your confirmation email repeats this. For a pass that extends access you already have, its access starts when its days begin. Nothing in these Terms removes any other right you have under the consumer law of the country where you live.

5. Use of Services

5.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Platform and Services for personal, non-commercial educational purposes.

5.2 Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You may:

  • Take practice exams to prepare for certification tests
  • Review your performance analytics and exam history
  • Read our study guides and the explanations included with your access
  • Contact support for assistance with our Services

5.3 Prohibited Activities

You agree NOT to:

  • Share, distribute, or sell your account access to others
  • Copy, reproduce, or distribute any exam questions, answers, or content
  • Use automated tools, bots, or scripts to access our Platform
  • Attempt to bypass security measures or access restricted areas
  • Reverse engineer, decompile, or disassemble any part of our Platform
  • Use our content to create competing products or services
  • Share exam content on social media, forums, or other websites
  • Screenshot, record, or capture exam content by any means
  • Impersonate another person or misrepresent your identity
  • Engage in any activity that disrupts or interferes with our Services

6. Exam Rules and Conduct

6.1 Practice Exam Environment

Our practice exams simulate real certification testing conditions. When taking an exam:

  • Each exam has a specified time limit that will be enforced
  • Questions are randomly selected from our question bank
  • Your answers and results are recorded for performance tracking
  • An exam you have started is saved as in progress, so you can return to it if you close the page or lose your connection

6.2 Exam Integrity

To maintain the quality and integrity of our practice exams:

  • Do not share exam questions or answers with others
  • Do not use external resources during timed practice exams
  • Report any errors or issues with questions through our support system

7. Intellectual Property

7.1 Our Content

All content on our Platform, including but not limited to exam questions, answers, explanations, text, graphics, logos, and software, is the property of The Mock Exam or our licensors and is protected by intellectual property laws.

7.2 Restrictions

You may not:

  • Reproduce, modify, or create derivative works from our content
  • Distribute, publicly display, or publicly perform our content
  • Use our content for any commercial purpose
  • Remove any copyright or proprietary notices from our content

7.3 Trademarks

Certification names, logos, and trademarks mentioned on our Platform (such as AWS, Cisco, CompTIA, Google Cloud, ISACA, ISC2, Microsoft, MikroTik and PMI) are the property of their respective owners. We are not affiliated with, authorized by, or endorsed by these certification bodies unless explicitly stated. Our practice exams are independently produced study aids and are not official exam material.

8. Disclaimers

8.1 No Guarantee of Results

Our practice exams are designed to help you prepare for certification tests. However, we do not guarantee that using our Services will result in passing any certification exam. Your success depends on various factors including your preparation, knowledge, and the actual exam conditions.

8.2 Content Accuracy

While we strive to provide accurate and up-to-date content, we do not warrant that our exam questions perfectly match actual certification exams. Certification exam content and objectives may change without notice from the certifying bodies.

8.3 Service Availability

We aim to provide uninterrupted access to our Services but do not guarantee that our Platform will be available at all times. We may experience downtime for maintenance, updates, or unforeseen technical issues.

8.4 "As Is" Basis

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • We shall not be liable for any loss of profits, data, or business opportunities
  • Our total liability for any claims arising from these Terms or your use of our Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless The Mock Exam, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit or share through our Platform

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting our support team. Upon termination, your right to access our Services will cease immediately.

11.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • Any conduct we deem harmful to our Platform or other users

11.3 Effect of Termination

Upon termination:

  • Your access to the Services will be revoked
  • Your exam history and data may be deleted
  • You remain liable for any outstanding charges
  • Provisions of these Terms that by their nature should survive termination will remain in effect

If we terminate a paid account for a reason other than your breach of these Terms, we will refund the unused portion of any pass or subscription you have already paid for.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our Platform with a new "Last updated" date. Your continued use of our Services after any changes indicates your acceptance of the modified Terms.

We encourage you to review these Terms periodically to stay informed of any updates.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Mock Exam regarding your use of our Services.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our Services shall be resolved through appropriate legal channels.

If you are a consumer, nothing in this section deprives you of the protection of any mandatory consumer law of the country in which you reside, or of any right you may have to bring proceedings in the courts of that country.
